The following agreements, disclaimers, policies, terms, and conditions, apply to http://www.homelightingneeds.com.
The use of, and advertisement of this site is intended for those individuals who are of legal age in their state or province.
The access and use of this site as a means of information or to complete a transaction identifies that the purchaser, referred to herein as "you", and "your", whether as an individual or organization and in singular or plural identification, agrees with/will adhere to, the following agreements, disclaimers, policies, terms and conditions. C GAT Products and Home Lighting Needs shall be referred to herein as "the company", "retailer", "us", "we", and "our". Any lighting product available through this website, including but not limited to lamps, chandeliers, light fixtures, etc., shall be referred to herein as "the product" "it", "its", or "the item".
As a retailer, we make products available for you to purchase by dealing with 3rd party suppliers and manufacturers. From time to time, some of the products advertised on our website may be out of stock or unavailable for a period of time whatever. Our goal is to advertise all available stock; however, should there be a change in your item's availability, manufacturing, or delivery, we will notify you as soon as possible.
All items are sold without light bulbs.
Safety Recommendations
Once you have decided to purchase an item from us, we strongly recommend that you consider adhering to the following suggestions:
All of the products are handled by professionals, reviewed, and are in good working order before they are shipped out to you; however, once you have received your item:
- Have it immediately inspected by a practicing licensed electrician available in your area.
- Have it installed by a practicing licensed electrician available in your area.
Please note that whether or not you choose to follow the above mentioned safety recommendations, you agree to release C GAT Products and Home Lighting Needs from any liabilities and encumbrances (please read our section on liabilities for more detail on this).
Liabilities
Whether informational or transactional, it is understood that by, using this site or the inability to use this site, you agree to release, C GAT Products and Home Lighting Needs from direct, indirect, special, incidental, unintentional, or consequential damages, and find harmless from any such liabilities and encumbrances, for anything you do or hire someone/company to do, including but without limitation to, cost incurred due to errors or successes of, installations, repairs, inspections, wiring, and estimates/quotations, losses of/to, replacements of/to, damages of/to, including punitive damages of/to, persons including employees, agents, representatives, management, executives, contractors and the like, employment, revenue, goods, services, venue, real estate, and time.
Use of Personal Information
All personal information you provide through the use of this site (name, address, credit card number etc.,) will be considered to be yours, and will be used for the sole purpose of completing your transaction and shipping your item(s). All information you provide will be held in strict confidentiality and will be used for communication purposes. We do not sell or trade your personal information to 3rd parties for any marketing purposes. Only your address and telephone information will be provided to our suppliers should it be necessary to ship your product(s).
Shipping
All products are priced in US dollars and include shipping costs within the continental U.S.A. (excluding Hawaii and Alaska). Any product(s) that are available to be shipped outside of the continental U.S.A. will have the following flags referring to their shipping destinations:
 - Alaska and Hawaii  - Canada  - International
If the item(s) are available to be shipped outside of the continental U.S.A. (i.e. Hawaii, Alaska, Canada, Europe, Asia, etc.) please contact us at info@homelightingneeds.com for calculations of additional shipping charges.
With consideration of the distance from the manufacturer/supplier to your location, shipping times may vary. Estimated shipping times are between 4-6 weeks. If; however, you are purchasing a custom made item, the shipping time could be longer due to the hand crafting and detail process. Our goal is to continually maintain a high standard of service by providing optimal performance in all aspects of our transaction(s) with you. In accordance with the Ministry of Finance, Province of Ontario residents will need to add 8% RST (Retail Sales Tax) to their order (please read our sales tax policy section).
Sales Tax Policy
In accordance with the Ministry of Finance, Province of Ontario residents will need to add 8% Retail Sales tax (RST) to their total purchase price. If you have a valid exemption certificate, please provide us with a signed copy of the certificate within 7 days of your purchase. Failure to do so will result in the sales tax being charged and non-refundable.
Return Policy
We encourage you to proceed with any order once you are confident you wish to purchase the item(s). Please ensure your purchase is a firm one as our re-stocking fee is 50% of the cost of your purchase + shipping and handling fees. Should you wish to return your item for any reason, please notify us as soon as possible and within 7 days of receiving your product at info@homelightingneeds.com for instruction of where the item is to be sent. The item is to be returned in its original package and in the same condition in which it was received. You will be responsible for all shipping and handling charges. Once the returned item has reached the warehouse, your credit card/original form of payment will be credited the difference owing after the re-stocking, shipping, and handling fees.
Damage Policy
Much care is put into the preparation of the delivery/shipping of all products; however, we advise you to inspect it thoroughly upon receipt. Should there be any damage to the item through the shipping process, please notify us immediately upon receipt of the item and within 24 hours at info@homelightingneeds.com for instruction of where the item is to be sent. The item is to be returned in its original package and in the same condition in which it was received. You will be responsible for all shipping and handling charges. If we do not hear from you within 24 hours of the receipt of your item, it will be assumed all is well and the product will be deemed yours and the transaction complete. Once the returned item has reached the warehouse, your credit card/original form of payment will be credited the difference owing after the shipping and handling fees.
Disclaimer
Please note that although every effort is made to ensure that the information on homelightingneeds.com is accurate, we accept no legal responsibility for any errors and/or omissions including but not limited to such things as typographical errors. Dimensions, sizes, etc. may change as manufacturers update their products and make minor changes; therefore modifications may be made and specifications may change without notice. Notwithstanding this, C GAT Products and Home Lighting Needs will make every effort to accommodate your order.
Cancellation Fee/Right to cancel
Please note, you will have a 24 hour "cooling off period" from the completion of your order/checkout where you may change your mind and not proceed with your transaction. Should you wish to exercise this right, a 5% ordering fee will be retained to cover C GAT Products' administrative costs. Once the "cooling off period" has expired, we reserve the right to apply a 10% of your purchase cancellation fee for any orders that are cancelled prior to shipping. If your product has been shipped, you will need to follow the information/instruction provided in the return policy. We encourage you to proceed with any order once you are confident you wish to purchase the item.
